Hi All,

Need some comments on my situation. My lawyer filed for my I-140, I-485, AP, and EAD on November 20th on EB2 Row Category. I just emails yesterday stating that my EAD card is sent to production, but they have asked for initial evidence on 485. Is it possible to review 485 without looking at the 140? I am not sure what that query is, but really hoping that it is not something serious. I've already waited for 16 months for my Labor to get approved. Please share your experiences, suggestions etc. regarding this.

yes, 485 processing and 140 processing is different. They are joined thread, So they will not approve 485 until your 140 is approved.

I don't think F-1 is dual intent. F-1 is non-immigrant visa. Dual intent means, even though the visa it self is non-immigrant but it has intent to change to immigrant visa, such as H-1B Temporary worker and K-1 Fiance visa.
For more accurate answer, consult an immigration attorney.

yes I had LUDS on Nov3, nov and Nov6..approval sent yesterday..

My RFE was about bachelor certificates..only..

because I had submitted all my w2s and tax stuff when i filed concurrently last year on aug 7 2007


Lawyer sent it on Oct 28 and recvd on nov 3..then in 2 days approval..

Hi There,

If My Project with company "A" is over and they are sending me back to india, but before going back i file transfer with company "B", once "B" gets the approval i can come back.

Can it be done this way?? i mean after transfer is filed can anyone go back to india or He/she has to be in US during this period??

If I understand correctly, once the I-140 is approved, the PD is fixed. Make sure you have all the details of your privious I-140.

you can take up new FT and once the new I-140 is approved and if EB2 July is current at that time, you can ask USCIS to apply that PD to your new I-140. Also the new I-140 needs to be with same or similar job duties / description.

Can I apply for 485 and then travel abroad, without getting advance parole?

I am on H1B and must travel to India to take care of a sick parent and would like to apply for 485 and then travel abroad....will this jeopordize my greeen card process?

You are OK if you are travelling on H1B. I never used my AP and always used H1B

Here is my situation and looking for any previous experience and suggestion from experts.

I have my EAD valid for 2 years PD 05 EB2. I got a job from another company but vendor says I need to be in his payroll. Job wise everything is good. I want to join him on EAD.
Here are my concerns

1. Should file for AC21 or just keep quite till CIS sends a letter ?
2. If I ensure my new job and old job responsibilities are same, am I safe ?

Do you see any problems or advise me for anything.

This will be a new H1 application since you never used the original one. You will need to go to the US Consulate with the new approved H1 document and they will ask you why u forsook the first one....
