I have a valid H4 after receving the EAD now getting paid on 1099 (on an off), I am planning to visit India this year. My question is!
Can I come back on H4 (I have a valid stamp) or do I have to use my AP since I am using my EAD privileges for getting paid?
Will they know at the Point of Entry that I am using my EAD?
Many thanks for viewing and answering!

Hi,
There are some changes in applying for US visa from canada.
Please read this article, talk or find someone who recently tried it, make sure there are no issues and then plan your travel.
MurthyDotCom : Change in Procedures to Apply for a U.S. Visa in Canada (http://murthy.com/news/n_chacan.html)
There is a change in the procedure for applying for a visa at a U.S. consulate in Canada, which went into effect September 1, 2010. As many MurthyDotCom and MurthyBulletin readers apply for U.S. visas in Canada, this information should help them to plan appropriately.
New Appointment System
To schedule a visa appointment in Canada, applicants must use CSC Visa Information Services to apply for a U.S. visa at a U.S. consulate in Canada. There are no surcharges for phone calls or access to the appointment service. There are standard visa issuance fees, of course, which are charged by the U.S. Department of State (DOS).

Emergency Appointments
A limited number of visa applicants may qualify for emergency visa interview appointments. To obtain an emergency appointment you must satisfy one or more of the criteria listed below.
The criteria:
For applicants from all consular districts
*
You need to obtain emergency medical care or accompany a relative or employer for emergency medical care
*
You need to attend the funeral of an immediate family member (mother, father, brother, sister, child, grandparent or grandchild)
*
You need to attend to an urgent business matter where the need to travel to the U.S. could not be predicted in advance
*
You are a student or exchange visitor who is within 90 days of the start date of your valid program and who was not denied a visa within the last six months
*
You are a temporary worker (H & L visas only) whose visa has expired and who wants to renew your visa and return to your employment in the U.S.
*
You need to make an appearance in a U.S. court
For applicants from the New Delhi and Kolkata consular districts
* One or more of the criteria above; and/or
* You are a parent, sibling or grandparent who needs to attend the marriage ceremony or graduation of an immediate family member (son, daughter, brother, sister or grandchild).
Question:
Why is a Marriage or graduation ceremony considered an emergency by the New Delhi and Kolkata consulates and not so by the Chennai consulate?
(extra points for creative answers  )

Hi,
Can I work for a couple of days using tax form 1099 while on H1B? The amount for the number of hours while working will be less than $600. Please help.
No 1099 needs to be filed by the entity writing the check, if the amount is less than $600. Declare it as "Other Income" (probably with a Schedule "C", please check) on your tax return. Check IRS.GOV and www.investsafe.com/language.html

WASHINGTON - Senate Republicans and Democrats closed in on a last-minute compromise Thursday on legislation opening the way to legal status and eventual citizenship for many of the 11 million immigrants living in the United States illegally.
Sen. John McCain, R-Ariz., said he had been assured President Bush supports the measure, and would publicly say so later in the day.
As outlined, the measure would provide for enhanced border security, regulate the future flow of immigrants into the United States and offer legalized status to the millions of men, women and children in the country unlawfully.
"We've had a huge breakthrough" overnight, said Majority Leader Bill Frist, R-Tenn.
Not done deal yet
Sen. Harry Reid of Nevada, the Democratic leader, agreed, but cautioned that the agreement had not yet been sealed.
Even so, the presence of both leaders at a celebratory news conference underlined the expectation that the Senate could pass the most sweeping immigration bill in two decades, and act before leaving on a long vacation at the end of the week.
The developments marked a turnaround from Wednesday, when it appeared negotiations had faltered. The key sticking point involved the 11 million illegal immigrants in the country, and the struggle to provide them an opportunity to gain legal status without exposing lawmakers to the political charge that they were advocating amnesty for lawbreakers.
While final details were not available, in general, the compromise would require illegal immigrants who have been in the United States between two years and five years to return to their home country briefly, then re-enter as temporary workers. They could then begin a process of seeking citizenship.
Illegal immigrants here longer than five years would not be required to return home; those in the country less than two years would be required to leave without assurances of returning, and take their place in line with others seeking entry papers.

I think this is a step forward...but aint cutting it...your status remains "in process for years"...everyday check the same url and it says gives the same stale status...what we need is a way to make a resonably accurate guess as to when my LC will go into the next stage..
The process and results need to be predictable....!!!

Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.
1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.
2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?
3. If company A cancels the 140, still can I able to port the PD ?
thanks.
CS
If your I-140 is approved and dates not current you can get one time three years H1 extension. Otherwise one year extension is available.
Since your I-140 is approved You can port the priority dates even if Company A revokes the I-140

Pezz,
I hope you get some good suggestions- just a little thing- your attorney does not have to be located where you are, a lot of people deal long distance!
Please don't forget to join your state chapter and sign up for the rally. We are counting on a strong presence from the Philadelphia area and indeed all PA!

While I laugh at that guy. I would like to remind you that we are living in a republic and not in a democracy.
Any one can be a self hurting fool using his/her "Individuals God-given, unalienable rights". While in a democracy individuals worry about majority rule and popular thought.
I dont understand why Obama (a former senior lecturer in constitutional law ) refers to this country as democracy.
HELLO Chicago. If there is anyone out there who still doubts that America is a place where all things are possible; who still wonders if the dream of our founders is alive in our time; who still questions the power of our democracy, tonight is your answer... "
While the founders were fearful of democracy ( the mob rule ).
Both India and USA are republics not democracies.

Hi guys,
I am new to this forum. I am a recruiter and I have a candidate for a position in the US who is close to getting an offer. Here is my situation, any help would be appreciated.
Candidate is a Canadian Citizen currently in the US working with TN (Nafta Visa)
He has renewed his TN 4 times.
He is now close to receiving an offer from my client, but his current company just filed his petition for a H1B visa.
Not sure what is best for him and new employer. Candidate just received an email from his HR that he can't travel during petition, but would the new job, he will need to go to Israel for training. Can he make a request to his current employer to withdraw his petition once he decides to change companies in order to do TN visa again?
Any help would me much appreciated.

Hi,
I got an RFE on EAD Renewal and notice says the following.
The application you submitted must bear the original signature of the applicant. You must sign the attached copy of Form I-765 in the signature block marked in Red.
I got only RFE notice with this information and there is no attachment with this RFE.
I am 200% sure that I signed the application.
Now I have no idea what to do and there is no attachment to sign.
I filed myself without attorney help.
Any one please help me how to handle this RFE.
Can I send new I-765 application or request again for attachment
My EAD expiring on 8/26/2008
Paper based application
Applied on May 5th 2008 at NSC
Thanks,
You might have signed using a black ink. Now-a-days, the photocopiers are so cool, you can not differentiate between original and a copy. It could be one of the reason, USCIS has sent an RFE on your EAD. Write a cover letter, Fill a new 765 form with the same details as the one you last sent and Remember to sign in BLUE ink.
