My LCA for H1B extn for 6 years is approved on July 15. But still my company lawyer is not ready to file the extn. He keeps on saying that I didn't get the approval notice from DOL, It's certified online only, So without physical approval document, I cannot proceed.
Guys, Since it's certified already, Can he get a LCA detail and print using his account from iCert?
I also checked the online status in iCert (he gave me the case No), the status says certified.
So in this How long DOL took to send the physical copy of LCA?
Since my H1B is expiring October, I need to file extn ASAP. My company lawyer is not helpful ...

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. I recently found a new job and they filed for my H1 transfer in premium processing. I am still working for my old employer. Now I have got an RFE questioning why my salary (in 2009 W2) which is less than what was mentioned in my previous petition. Even though I have all my paystubs I was on bench for few months between march - may 2009. I have a leave letter for 4 weeks vacation in may and my salary was reduced when I got new project. Which explains why it is less but may not be enough to prove it to USCIS. Salary in W2 could also be less that prevailing wage. Right now I have following scenarios
1. WIthdraw application - not sure repurcussion of this.
2. Respond to RFE with mentioned reason which can have following outcomes
a) Appoved - (good i will be more than happy)
b) Approved with consular processing - (I dont want to travel at this point of time outside US)
c) denied - (not sure)
3. This case goes to DOL and there may be investigation or indent of revoke sent to my employer. Can this happen?
Here are my questions
1. Senario 2.b. If I get "Approved with consular processing" do I have to travel to India for stamping immediately or just get new I94? What will be my current status then? What if I decide not to join the new employer?
2. Senario 2.c. If I get "Denied" what will be my current status?
3. What should I do so that I am not out of status and I dont have to travel to India for stamping?
4. Scenario 3, Can this happen?

I am a silent reader of Immigration voice forum and have got great information about H1B and other related issues on this forum.. Today, I am in dilemma as what to do in following situation and I thought you all will be able to help me by answering my questions. Here I go:
I am on H1B and my wife [on H4] graduated [MS] in Dec'06. Because she completed her MS in Rehabilitation counseling on H4, she does not have OPT to start the work. Now, she has got a job offer from private rehab firm and they are ready to file her H1. I would like to know following:
1. Is she eligible for 20000 MS quota exemption?
2. According to H1B visa reform act of 2004, such exempt applications were allowed to be filed on March 8, 2005 for FY2006. Is this the case for future fiscals as well?
3. If the H1B application is filed by lawyer say on April 1, 2007 in premium processing, can it be approved in 15-20 days i.e say April 15.

Hi,
I just became unemployed (today) but I obtained my GC through employment about 2 years ago. I have some questions:
I am planning to spend about a week or 2 in Canada, will that cause me any problems when I come back to the US? I will keep job hunting in Canada but for a job in the US as I intend to stay in the US.
Am I entitled to unemployment benefits since I have a GC?
Will my layoff create any problems for me when I want to become a citizen of the US in about 3 years?

No it shouldnt take that long. However if you are not in a hurry, wait for 30 days and call the USCIS to see if it was sent back (which is unlikely in your case).
And dont waste your time by calling the officials or making Infopass appointments. Apply for a duplicate EAD asap. Yes, you have to pay the fees.

Both of those lenses aren't the fastest, so you're going to want a sensitivity of 1600 to get acceptable shutter speeds to minimize motion blur. If the light is changing a lot, you could use aperture priority, leaving the aperture at the widest it will go (or stopped down however much you can while maintaining reasonable shutter speed).
If the light is relatively constant (and when has that happened at a concert?), you might get more consistent results from determining the correct exposure by test shots and histogram, and then leaving things set until the light changes.
If you want help with autofocus, I'm afraid that I can't help, as my Nikon is a bit older than yours (D1). :(

Hi, I am an Indian citizen working on a H1b visa. I need a Canadian tourist visa (TRV). I am planning to go to the Canadian consulate in Detroit. Would you know if Canadian Detroit consulate allows walk-in visa appointments. Is there any specific day or time when they permit walk-ins and how long does it take to get stamping. If Detroit does not, does consulate at Seattle or Buffalo allow walk-ins.

My spouse got her GC in Sep/2000 filed by her parents. Then went back to India to continue studies with 2 yr permission from INS. Return to US after 2 yr and stayed for 8 months in US and then took trip again back to India for 7 months. And then return back in May/2004 and still here since then.
Outline:
Got GC -- Sep/2000
out of US (Nov/2000 - Oct/2002) with permission from INS or USCIS.
Return to US -- Nov/2002
Stayed 10 months in US
Trip to India --- Sep/2003 (for 7 months)
Return to US -- April/2004
Since April / 2004 here in US.
based on this stasts we my spouse apply for citizenship.
USCIS work sheet eligibility says >> 5 yr GC ->> If not out for 30 months in last 5 yr (true) >> No trip out side of US more then 1 yr. (FALSE - If so execpetion -- took permission - true) >> good moral >> etc., >> APPLY FOR CITIZENSHIP.
But when read the eligi. requir. its says absence more then 1 yr cancel all previous contin. of stay ??? confused with this both understanding.....

I am sure a lot of people waiting for EADs for their spouses will be having well qualified spouses who can volunteer their time. We have lawyers available to be on calls, but people do not even send questions on time when we announce. We organize calls on weekends, and only few people show up. However we get thousands to show up on tracker threads everyday.
We are doing this as a free service to the community. If people do not value it and help us, they can get their own own lawyers and get paid consultation.
We will not be posting recording for people who do not even want to give us a minute and complete their profile so that we can contact them. The service may also be discontinued if members do not see any value in it.

140 Approved from TSC last year.
EAD is self-filed later on Aug 14th @ NSC with USPS tracking# proof.
But EAD check cashed today from NSC (LIN#)
It's crazy. What I can say more.
Hi all : After talking to an IO, I discovered that using my name and DOB, they could only trace my application till I-140. They couldn't see any applications for I485/EAD/AP for myself and my husband. Huh.. weird.. What should I infer from this so-called drama. What should be my next move? Pls. advise.
My attorney gave me a FEDEx tracking number, which states it was recd. by j. Barrett (NSC) on 2nd July. My application was complete with all different checks and all original medicals for me and my husband.
This is ridiculous. Does it mean, NSC has lost my application (s)? I see LUD as of 8-5-07 on my approved I-140 number as per USCIS website? What does that mean? Gee. This is crazy.
Thanks if anyone can help me figure out this mystery.

My company applied for my H1B extn and after 3 months the status got changed to RFE... when the company lawyers recieved the letter, they reviewed it and emailed me the text below....
"Our office just received the Request for Additional Evidence from CIS by mail. What they requested in the letter is not applicable to your case and we believe CIS issued this RFE by mistake. We will respond to CIS to clarify this issue and will keep you informed if there is any update."
I have requested my company lawyers on the specifics...

If he's already got 1 I140 with older date.. got thro' process once again.. Apply thro' PERM and get EB2 the right way and then get GC in 6 months!
