My lawyer kept the original as well and I specifically ask him to keep it. Lawyers typically have good filing system. I frequently move from one house to another because I am not fully settled yet. I might lose some of those important documents during the transfers so I thought the lawyer should keep the original.

H-1B Quota is still available for all employers. Employers who have not yet proceeded with new H-1B filing can go ahead now too as per their business requirements. After many years since the Cap of H-1B started, it is still available even after Sept. 30, 2009. As of this writing, there are still H1B cap numbers available, both in the advanced-degree and regular H1B quotas. This means that H1B petitions can still be filed for fiscal year 2010. These filings can continue, as long as the cap numbers are available.
We like to share that H-1B petitions can be filed throughout FY10, until the cap numbers are all depleted. Petition filed under the 2010 Cap after October 1, 2009, the start date of work requested can be immediate. Since October 1, 2009 has already passed, and the H-1B numbers are still available, filings may request an immediate validity date. Like earlier, the start date for H-1B work can be as much as six months in the future, depending upon the needs of an employer. Usually one has to start the H-1B Cap process 6 months in advance of the requested start of employment, employers were all doing so in order to increase their chances of obtaining one of the limited cap numbers. Thus, cases were filed at the beginning of April, requesting an October 1st start date. However, we are now beyond October 1st, and Cap numbers remain available, it is possible to pick a more desirable start date, ranging from immediate to six months in the future.
There is not much progress in cases filed in FY 2010 quota yet. However, there is sharp increase in filings. The regular cap increased by 1600 cases between the end of August and the end of September, for a total of 46,700 as of September 25, 2009. This reflects a higher rate of filings than in the prior few months which may be due to re-filings and fresh filing as per upcoming requirements. We will keep you posted on further developments.

I have a question. I am a July 2nd 485, EAD, AP filer and I did not receive my AP yet. My H1 visa stamping got expired, and I am planning to go to India for 2 months. Can I leave US before my AP gets approved, hoping that it will be approved in the next 2 months time and my attorney will send the AP papers to my India address?
Is it possible, please advice.

If you are a French citizen, then yes, you can get a new H1-B visa stamp at the US Embassy in Paris. But if you are a citizen of another country, then no, you cannot get a US H1-B visa in Paris. You have the option of getting an appointment and going to a US Embassy/Consulate in Canada, Mexico, or your country of citizenship.
Whether the French will give you a French visa is another question, but regardless, you will have to have a new US H1-B visa to get back into the country.

I am travelling to India and I have got AP. I also have an I-94 when I arrived last time to US. This is expired and I also have a I-94 with my last H1b (expires in June 2010). Now, I am working on EAD.
My question is which I-94 I need to return to the Airlines while boarding the flight?
Also, I am starting my flight from Cincinnati to Washington. From Washington I have a connection to Dubai and then to Chennai. Where should I submit my I-94?

Apparently, no movement for EB3 ROW from November 2006 - April 2007:
November - 2006: 01AUG02
April - 2007: 01AUG02
In May 2007, it jumped to 01AUG03. I hope that there will be a movement in Jan 2009, Feb 2009 VB but looking at the trends it doesn't smee like there will be any.

If the new PWD guidelines were effective 01/01/10, then it shouldn't effect your PWD since it was filed on 12/30/09. You should try and find some document or FAQs to prove the same and send them to your lawyer. My guess is he might have messed up something in your process and is trying to cover it up with this story. Its better to have him re-start the process in that case because if he infact messed up something and he files your PERM, it could be potentially denied which will directly impact you...Try to find out if what he is saying is infact true (which I doubt), or if he is just mistaken..

All,
My 4 years and 2 months on H1B will finish in this November and we are in the process of applying for an extension. I have my 140 approved and waiting for my priority date to become current.
Can I apply for 3 years extension based on my 140 approval? or do I have to apply for 2 yrs extension to finish my 6 yrs first and then eligible to apply for 3 more years (if my priority date is still not current by then?). My HR is under the second impression (2 yrs and then 3 yrs).
Also, please can you specify the USCIS rule under which it is applicable?

I was in some what similar situation but my H1 transfer was not approved to the new company and my attorney suggested moving back to the previous employer.
I guess it is possible but if your H1 transfer was approved then you might have to apply for another transfer.
I worked with company A for 6 months and then transferred H1B to new company B with whom I worked for 1.5 years. Meanwhile company A did not cancel my H1B and now when I am thinking of joining company A. Can we use older H1B petition. Is it ok to use older H1B petition or should we cancel older H1B on file and file new H1B transfer?

She was a graduate of UCLA, and she was a tireless DREAM Act Advocate, having testified before Congress in favor of its passage.
Tam, herself was undocumented and found removable by an immigration judge who denied her and her family political asylum. On appeal, the Board of Immigration Appeals found that the family could not return to Vietnam because of fear of political persecution, so the US could not remove the family to Vietnam. Having been born in Germany, the government sought to remove her to her birthplace, yet Germany refused to grant her entry. Tam was stateless. The only home she knew was the United States.
This tragic accident took the life of another passenger, a fellow UCLA graduate and DREAM Act activist, Cinthya Felix. Fong & Chun, LLP offers condolences to the families of both Tam and Cinthya. --ecf

I have these below queries on Green card processing
My Green card processing background
My labor and I140 are approved and have priority date of May 2006 under EB3 category.
The reason for these questions is that I am planning to change the company that I am working with.
Questions.
1. Can I port the priority date (March 2006) when applying for new green card with new employer.
2. If possible to port the priority date can I apply under EB2 category assuming all other criteria satisfy for EB2 category and use the same (May 2006) priority date.

I just want to confirm that this ruling is still in effect. Use AP to return as Parolee, never used EAD, can continue to work for same employer on approved H1B petition. Are there others in this situation as well?

Thanks for the info. Is there any way of notifying USCIS, if the new job from existing employer is EB2 level (I mean a promotion to senior level) so that the application is processed quickly!
